NeurIQ Terms and Conditions

These Terms and Conditions, together with any additional terms, policies, or notices that we make available in or through NeurIQ, form a binding agreement between you and Buzzle LLC ("Buzzle," "Company," "we," "us," or "our"). These Terms govern your access to and use of NeurIQ, including the NeurIQ mobile application, related websites, features, content, subscriptions, support, and other services that link to or reference these Terms (collectively, the "Services").

Please read these Terms carefully. By downloading, installing, accessing, purchasing, subscribing to, or using the Services, you agree to these Terms. If you do not agree to these Terms, do not access or use the Services.

1. Overview of NeurIQ

NeurIQ is a cognitive training game app built around short, replayable exercises across areas such as memory, timing, perception, focus, and related skills. The Services may include features such as adaptive calibration sessions, a personal Signal Map, performance scores, progress tracking, daily recommendations, crowd benchmarks, audio or haptic cues, premium game modes, and advanced analysis features.

NeurIQ is intended for entertainment, personal insight, and general cognitive training purposes. The Services are not medical, clinical, psychological, educational, professional, or therapeutic services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

The Services are not directed to children under 13. If you are a parent or legal guardian and allow a minor to use the Services, you are responsible for that minor's activity, purchases, and compliance with these Terms.

By using the Services, you represent that:

  • You can form a binding agreement with us or have permission from a parent or legal guardian to use the Services.
  • You are not prohibited from using the Services under applicable law.
  • The information you provide to us is accurate, current, and complete.
  • You will use the Services only in accordance with these Terms and applicable laws.

3. Not Medical Advice or Healthcare

NeurIQ does not diagnose, treat, cure, prevent, screen for, monitor, or assess any disease, disorder, impairment, condition, or health status. The Services, including scores, Signal Map values, trends, percentiles, insights, recommendations, and other feedback, are generated from game performance and should not be interpreted as medical, psychological, neurological, educational, employment, fitness-for-duty, or professional advice.

You should not rely on NeurIQ as a substitute for advice from a qualified healthcare provider or other licensed professional. If you have concerns about your health, cognition, memory, attention, mood, development, neurological function, or performance, consult an appropriate professional.

Some users may experience seizures, photosensitive reactions, flashing-light sensitivity, dizziness, nausea, motion sensitivity, eye strain, headaches, hearing discomfort, anxiety, fatigue, repetitive strain, or other discomfort from visual patterns, rapid motion, flashing effects, timing tasks, audio cues, haptics, or extended screen use. Stop using the Services immediately if you experience symptoms and seek professional advice if appropriate. Use the Services in moderation, take breaks, and do not use the Services while driving, operating machinery, or doing anything that requires your full attention.

4. Accounts and Profiles

Some features may require or create an account, profile, anonymous user identifier, or cloud-backed session. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree not to:

  • Create an account using false, misleading, or unauthorized information.
  • Access another person's account without permission.
  • Share credentials in a way that allows unauthorized use of the Services.
  • Attempt to bypass authentication, account limits, purchase controls, entitlement checks, or security measures.

If you believe your account has been compromised, contact us promptly at support@buzzleco.com.

We may allow account creation or sign-in through third-party services such as Apple, Google, Facebook, or other providers. Your use of those services is governed by their own terms and policies, and we are not responsible for those third-party services.

5. Privacy

Your use of the Services is also governed by our Privacy Policy, available at https://buzzleco.com/neuriq/privacy/. The Privacy Policy explains how we collect, use, disclose, and protect information when you use the Services.

By using the Services, you acknowledge that we may process information as described in the Privacy Policy, including information related to accounts, device and usage data, purchase entitlement status, support requests, app performance, crash reports, gameplay activity, scores, progress, calibration, and benchmarks, where applicable.

6. Scores, Signal Map, Benchmarks, and Recommendations

The Services may generate scores, statistics, Signal Map values, progress trends, calibration results, recommendations, percentiles, rankings, or benchmarks. These outputs are estimates based on app interactions, scoring models, game difficulty, device inputs, available data, and other factors. They may be incomplete, inaccurate, delayed, unavailable, or affected by device performance, network conditions, accessibility settings, interruptions, app version, game balance changes, or other variables.

You understand and agree that:

  • Scores and insights are not professional assessments and should not be used to make medical, educational, employment, legal, financial, safety, or other important decisions.
  • Results may reflect practice effects within specific games and should not be interpreted as evidence of general intelligence, diagnosis, impairment, or real-world performance.
  • Crowd benchmarks and percentiles may be based on aggregated or limited data and may change over time.
  • We may update scoring models, calibration, difficulty, benchmarks, mode behavior, and analysis methods, which may change how results are calculated or displayed.
  • We may use aggregated or de-identified gameplay, score, calibration, and usage information to operate, improve, balance, and benchmark the Services, as further described in our Privacy Policy.
  • We do not guarantee that use of the Services will improve cognition, memory, attention, productivity, academic performance, job performance, health, or any other outcome.

7. Subscriptions, Purchases, and Premium Features

The Services may offer free features and paid features, including subscriptions or other in-app purchases such as NeurIQ Pro, NeurIQ Pro+, premium modes, advanced analysis, or downloadable content. Available plans, features, pricing, billing intervals, trial offers, renewal terms, and cancellation options will be shown in the app, app store listing, purchase screen, or subscription management interface at the time of purchase.

Purchases made through the Apple App Store, Google Play Store, or another app marketplace are processed by that marketplace and are subject to that marketplace's terms, conditions, billing rules, refund policies, and subscription management procedures. We do not receive or store your full payment card information when purchases are processed by an app marketplace.

Unless otherwise stated at purchase:

  • Subscriptions automatically renew until canceled.
  • Your app store account will be charged at confirmation of purchase and for each renewal period.
  • You must cancel through the applicable app store or subscription management settings before renewal to avoid future charges.
  • Deleting the app or deleting your account may not cancel an active subscription.
  • You may continue to have access to paid features until the end of the current billing period unless the applicable marketplace provides otherwise.
  • Free trials, discounts, introductory offers, and promotional pricing may be limited, may convert to a paid subscription unless canceled, and may be subject to eligibility rules set by us or the app marketplace.
  • Subscription benefits may vary by platform, region, app version, account status, and marketplace rules.
  • Taxes and fees may apply.

We may use service providers such as RevenueCat or similar vendors to help manage purchase entitlements, subscription status, paywalls, and access to paid features.

8. Cancellations and Refunds

You may cancel subscriptions through the applicable app store or marketplace account settings. Cancellation will generally take effect at the end of the then-current billing period unless the applicable marketplace states otherwise.

Refunds for purchases made through the Apple App Store, Google Play Store, or another marketplace are handled by that marketplace under its own refund policies. We cannot guarantee refunds and may not be able to issue refunds directly for marketplace purchases.

If you believe a purchase entitlement is not working correctly, use the in-app restore purchase feature where available or contact us at support@buzzleco.com.

9. Changes to Features, Pricing, and Availability

We may add, modify, suspend, discontinue, rebalance, rename, restrict, or remove any part of the Services at any time, including free features, paid features, game modes, scores, analysis, benchmarks, content, audio, visual assets, subscriptions, or support for certain platforms or devices.

We may change pricing, subscription plans, feature availability, trial offers, or promotional offers. If required by law or marketplace rules, changes to active subscriptions will be disclosed before they take effect.

We do not guarantee that any feature, content, score history, benchmark, entitlement, or version of the Services will remain available indefinitely.

10. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the Services for your own personal, non-commercial use on devices you own or control, solely as permitted by these Terms and applicable app store rules.

We and our licensors retain all rights, title, and interest in and to the Services, including all software, source code, object code, design, graphics, user interface, audio, music, sounds, text, game mechanics, mode names, scoring systems, algorithms, trademarks, service marks, logos, trade dress, content, and other materials, except for rights expressly granted to you in these Terms.

11. Restrictions

You agree not to, and not to assist anyone else to:

  • Copy, modify, adapt, translate, create derivative works from, sell, rent, lease, sublicense, distribute, publicly display, or publicly perform the Services except as expressly permitted by us.
  • Reverse engineer, decompile, disassemble, extract source code from, or otherwise attempt to derive the underlying code, models, logic, scoring systems, or algorithms of the Services, except to the extent such restriction is prohibited by law.
  • Interfere with, disrupt, damage, overload, or impair the Services or any systems used to provide the Services.
  • Circumvent, disable, or bypass authentication, security, access controls, subscriptions, entitlements, rate limits, anti-fraud measures, or technical protections.
  • Use bots, scripts, automation, emulators, modified clients, or other unauthorized tools to access, manipulate, scrape, benchmark, test, or interact with the Services.
  • Upload, transmit, or introduce viruses, malware, or harmful code.
  • Use the Services for unlawful, fraudulent, abusive, harassing, exploitative, infringing, or harmful purposes.
  • Misrepresent your identity, affiliation, age, purchase status, or authorization.
  • Use the Services to develop, train, benchmark, or improve a competing product or service without our written permission.
  • Remove, obscure, or alter proprietary notices in the Services.

12. User Submissions and Feedback

The Services may allow you to send us support requests, survey responses, bug reports, reviews, comments, suggestions, ideas, or other feedback ("Feedback"). You grant us a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, copy, modify, distribute, display, perform, and otherwise exploit Feedback for any purpose without compensation or obligation to you.

You are responsible for any information you choose to submit. Do not send us confidential, sensitive, proprietary, or third-party information unless necessary for support and you have the right to share it.

13. Third-Party Services and Content

The Services may depend on or link to third-party services, platforms, software, stores, payment processors, analytics providers, cloud providers, authentication providers, crash reporting providers, device operating systems, or other resources. Third-party services may include Apple, Google, Firebase, RevenueCat, social login providers, analytics tools, cloud services, and other vendors.

We do not control and are not responsible for third-party services, content, policies, availability, security, or practices. Your use of third-party services may be subject to additional terms and privacy policies from those third parties.

14. App Store Terms

If you downloaded the Services from the Apple App Store, Google Play Store, or another app marketplace, you also agree to comply with that marketplace's applicable terms and policies.

For users who download the Services from the Apple App Store:

  • These Terms are between you and Buzzle, not Apple.
  • Apple is not responsible for the Services or their content.
  • Your license to use the Services is limited to use on Apple-branded products that you own or control and as permitted by Apple's usage rules.
  • Apple has no obligation to provide maintenance or support for the Services.
  • To the extent any warranty applies and is not effectively disclaimed, Apple's sole warranty obligation is to refund the purchase price, if any, for the Services.
  • Apple is not responsible for addressing claims by you or any third party relating to the Services, including product liability claims, legal compliance claims, consumer protection claims, or intellectual property claims.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country and are not listed on a U.S. government restricted party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

15. Updates

We may provide updates, patches, bug fixes, new versions, or changes to the Services. Some updates may be required to continue using all or part of the Services. If you do not install updates, some features may not function correctly or may become unavailable.

Updates may modify, remove, or reset features, scores, game balance, visual assets, audio assets, content, compatibility, or settings. We are not obligated to provide any specific update or continue supporting any specific device, operating system, or app version.

16. Availability and Internet Access

Some features may require internet access, cloud services, app store services, downloads, authentication, purchase validation, or third-party integrations. You are responsible for obtaining and paying for any internet, mobile data, device, operating system, and other resources needed to use the Services.

The Services may be interrupted, delayed, unavailable, inaccurate, or limited due to maintenance, updates, outages, device issues, network issues, third-party service failures, security incidents, excessive demand, or events outside our control.

17. Account Deletion and Termination

You may stop using the Services at any time. Where available, you may request account deletion through the app or by contacting support@buzzleco.com.

If you are a parent or guardian and believe your child has used the Services in violation of these Terms, contact us so we can review appropriate account or data-deletion options.

We may suspend, restrict, or terminate your access to all or part of the Services at any time if we reasonably believe that:

  • You violated these Terms or applicable law.
  • Your use creates risk, liability, security concerns, or harm to us, other users, third parties, or the Services.
  • Your account, purchases, or activity appear fraudulent, abusive, or unauthorized.
  • We are required to do so by law, marketplace rules, or a third-party platform.
  • We discontinue the Services or any relevant feature.

Termination may result in loss of access to your account, profile, progress, scores, settings, purchases, entitlements, or other data, subject to applicable law, app store rules, and our Privacy Policy. Account deletion may not automatically cancel active subscriptions purchased through an app store.

18. Intellectual Property

The Services are protected by copyright, trademark, trade secret, and other intellectual property laws. NeurIQ, Buzzle, related names, logos, designs, graphics, user interface elements, game concepts, mode names, scoring displays, content, and other brand elements are owned by or licensed to Buzzle.

Except for the limited license expressly granted in these Terms, you receive no right, title, or interest in or to the Services or any intellectual property associated with the Services.

If you believe that material available through the Services infringes your intellectual property rights, contact us at support@buzzleco.com with enough information for us to review your claim.

19. Copyright Complaints

If you believe that content in the Services infringes your copyright, you may send a notice to support@buzzleco.com that includes:

  • Your name and contact information.
  • A description of the copyrighted work you claim has been infringed.
  • A description of where the allegedly infringing material is located.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
  • Your physical or electronic signature.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate.

20. Communications

We may communicate with you through the Services, app store mechanisms, email, push notifications, device notices, or other reasonable methods. Communications may include service announcements, account notices, purchase or subscription information, support responses, security alerts, updates, policy changes, and, where permitted, marketing messages.

You may be able to opt out of certain communications through device settings, app settings, unsubscribe links, or by contacting us. You may still receive transactional or service-related communications that are necessary for the Services.

21. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, compatibility, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.

We do not warrant that:

  • The Services will be uninterrupted, secure, timely, error-free, or available at any particular time or location.
  • Scores, benchmarks, recommendations, calibration, Signal Map values, analytics, or other outputs will be accurate, complete, reliable, or useful for any particular purpose.
  • Defects or errors will be corrected.
  • The Services will meet your expectations or produce any particular result.
  • The Services will be compatible with every device, operating system, app store account, accessibility setting, or network environment.
  • The Services or servers are free of viruses or harmful components.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

22. Limitation of Liability

To the fullest extent permitted by law, Buzzle and its owners, officers, employees, contractors, agents, affiliates, licensors, vendors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of profits, revenue, data, goodwill, use, business opportunity, or other intangible losses, arising from or relating to the Services or these Terms, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising from or relating to the Services or these Terms will not exceed the greater of:

  • The amount you paid to us for the Services in the three months before the event giving rise to the claim; or
  • One hundred U.S. dollars (US $100).

The limitations in this section apply to all theories of liability, whether based on warranty, contract, statute, tort, negligence, strict liability, or otherwise. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

23. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Buzzle and its owners, officers, employees, contractors, agents, affiliates, licensors, vendors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or relating to:

  • Your use or misuse of the Services.
  • Your violation of these Terms.
  • Your violation of applicable law or third-party rights.
  • Information, content, or Feedback you submit.
  • Fraudulent, abusive, unauthorized, or harmful activity associated with your account or device.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

24. Governing Law and Venue

These Terms and any dispute arising from or relating to these Terms or the Services will be governed by the laws of Connecticut, without regard to conflict-of-law rules, except to the extent those rules are preempted by federal law or consumer protection laws in your location.

Subject to the dispute resolution section below, you and Buzzle agree to the exclusive jurisdiction and venue of the state and federal courts located in Connecticut, unless applicable consumer protection law gives you the right to bring claims in another forum.

25. Dispute Resolution

Before filing a claim, you agree to first contact us at support@buzzleco.com and attempt to resolve the dispute informally. Your notice should include your name, the email address associated with your account if applicable, a description of the dispute, and the relief you seek. We will attempt to resolve the dispute informally within 30 days after receiving your notice.

If you want to include binding arbitration, class-action waiver, jury trial waiver, or small-claims procedures, those provisions should be added only after review by qualified legal counsel for the jurisdictions where you operate.

26. Consumer Rights

Nothing in these Terms limits any rights that you may have under applicable consumer protection, privacy, app store, subscription, refund, or other laws that cannot be waived by contract. If any provision of these Terms is inconsistent with rights that cannot legally be limited, those rights will control.

27. Export Control and Sanctions

You may not use, export, re-export, import, sell, transfer, or provide access to the Services except as authorized by United States law and the laws of any other applicable jurisdiction. You represent that you are not located in a country or region subject to applicable embargoes or sanctions and are not on any applicable restricted party list.

28. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date above. If changes are material, we may provide additional notice, such as through the Services, by email, or through an app store notice.

Unless otherwise stated, updated Terms become effective when posted or made available. Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

29. Assignment

You may not assign or transfer these Terms or your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, financing, reorganization, change of control, or by operation of law.

30. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

31. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. Any waiver must be in writing and signed by an authorized representative of Buzzle.

32. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms or policies that apply to specific features, purchases, subscriptions, promotions, or platforms, are the entire agreement between you and Buzzle regarding the Services and supersede any prior or contemporaneous agreements regarding the Services.
